Terms and Conditions

1. DESCRIPTION
These terms and conditions apply to all Pinewood group bookings.
For the purposes of this document, a group is defined as any:
reservation comprising 15 persons or more;organised tour party with accompanying guide; reservations comprising multiple return bookings whose arrival dates are more than 3 months henceforth.

2. Quoted Rates
These rates apply to all reservations as quoted in association with these terms and conditions.
Rates are net and not commissionable.
Rates are in New Zealand dollars and must be settled directly with Pinewood in NZ dollars. All rates are inclusive of GST.
Pinewood reserves the right to increase quoted rates by notice in writing at any time prior to receipt of the deposit.
Accommodation (and meals where appropriate) must be prepaid prior to check-in unless credit has been established with Pinewood.

3. CONFIRMATIONS, CANCELLATIONS & NO SHOW CONDITIONS
Bookings are provisionally reserved upon receipt of a valid credit card. This credit card will be held on account as security against damage and settlement of any outstanding balance in the event of non-payment.

Final confirmation is made upon payment of a 25% deposit 60 days prior to arrival. Failure to pay the deposit by the due date may result in the cancellation of your booking.

In the event of cancellation, Pinewood reserve the right to charge a cancellation fee as follows:

30-15 days prior to arrival  - 10%

14-3 days prior to arrival     - 10% – 25%

72 hours prior to arrival      - Loss of deposit OR Charge equivalent to 1st night accommodation, whichever is greater.

Any reservation that is subject to a no show, will incur a charge of one nights accommodation. In such a situation any further nights booked in the reservation will automatically be cancelled.
Notification
(a) 60 days:

the Organiser shall return to Pinewood the signed “Deposit Request Form” with the required deposit no less that 60 days prior to the reserved date of arrival.
(b) 30 days:

the Organiser shall advise Pinewood in writing of the final numbers of the reservation no less that 30 days prior to the reserved date of arrival.
(c) 7 days:

the Organiser shall advise Pinewood in writing the guests names and sharing arrangements no less than 7 days prior to the reserved date of arrival. This rooming list is a requirement for fire regulations and must be completed prior to check in.

If the operator fails to comply with any of the provisions of a, b, or c, Pinewood may cancel the reservation at any time at their sole discretion.

All booking amendments are subject to availability. Pinewood will at its discretion use its best endeavours to provide additional/ different accommodation, but changes to group numbers/configurations etc. may incur additional charges.

If circumstances beyond the control of the group organiser result in non-arrival or cancellations of rooms and the organiser has advised Pinewood at the earliest practicable opportunity, Pinewood may at its sole discretion reduce or waive charges.

4. TERMS OF PAYMENT
1. For established operators, where credit has been approved, the following conditions will apply:
a)       Upon completion of a credit application, the operator shall make payment to Pinewood on the 20th of the month following the date of the invoice. In the event that payment is not made by the 20th of the following month, Pinewood at its own discretion may terminate this agreement, place the operator on a pre payment arrangement and proceed with the necessary action to recover any outstanding payments.
b)    All payments required to be made by the operator must be paid without deduction and payment must not be withheld or deferred on account of any claim, counter-claim or set off.
c)     Full details of any queries in connection with an account must be sent in writing to Pinewood before the 15th of the month following the date of the invoice or the account will be deemed to be accepted as correct.
d)         In the event of payment not being received by the 20th of the month following the date of the invoice Pinewood may advise the operator that until payment has been received all future reservations must be paid 7 days prior to arrival.

Failure to adhere to our terms of payment may result in the cancellation of your credit facilities.

2.     For all other group bookings, the following conditions will apply:
a)     The organiser will pay any outstanding balance prior to check in at Pinewood.
b)    Settlement of accounts can be made by:
·         Cash
·         Visa or Mastercard
·         Cheque (payment must be cleared 7 days prior to arrival)
·         Direct credit to Pinewood bank account prior to arrival

Please note: we do not accept AMEX, JTB or Diners Card for payment
c)    If payment is not received as required in Clause 2 (a), Pinewood will not guarantee the provision of accommodation and may cancel all reservations held.

5. ARRIVAL AND DEPARTURE TIMES
Check in time is 2.00pm. Guests arriving prior to this time may on occasions be provided with rooms when they arrive, but only by pre-arrangement.
Guaranteed access to rooms prior to 2.00pm can only be provided if the reservation includes the prior night.
Check out time is 10am. Later check out may on occasion be possible, but only by pre-arrangement.
Subject to the Pinewood status on the day of departure, guaranteed late check out to 6pm may be arranged at 50% of the quoted group rate.

6. RELOCATION POLICY
If for any other reason Pinewood is unable to provide all or part of the accommodation reserved, it will immediately contact the group organiser and use its best endeavours to secure comparable alternative accommodation. Pinewood will be responsible for any additional costs of accommodation exceeding those quotes by Pinewood and for any additional transport costs. Pinewood will not be liable for any further claims by the group organisers relating to relocation.

7. EVICTION
Management reserve the right to ask guests to leave for any of the following:

·         Drunken or disruptive behaviour
·         Violence, threats of violence
·         Verbal or physical abuse
·         Justified complaints about bad behaviour
·         Theft
·         Wilful damage to hostel property

7. FORCE MAJEURE
Pinewood will not be in breach of this agreement or any way liable to the group, if it is prevented from complying with this agreement by reason of Act of God, act of public enemy, war, earthquake, riot, fire, storm, flood, explosion, compliance with any law or government restraint order, rule regulations, strikes, lock outs or any other cause not reasonably within the control of Pinewood.

8. JURISDICTION
This agreement will be governed by the laws of New Zealand.

9. WAIVER
The waiver by Pinewood of any breach of any one or more terms and conditions contained in this agreement will not be construed to be a waiver of any succeeding breach of such terms or of any other terms.

10. ASSIGNMENT
This agreement cannot be assigned by the Tour Operator.

11. LIABILITY
Pinewood will not be liable for any loss of any kind whatsoever suffered by the organiser arising from any breach of this agreement by Pinewood or from any negligence, misrepresentation or other act or omission on the part of Pinewood.

Notwithstanding anything else contained in this agreement, the liability of Pinewood to the organiser, whether in contract or in tort, in respect of all claims, will not in the aggregate exceed the cost of the accommodation.

Pinewood and the organiser acknowledge and agree that the Consumer Guarantees Act 1993 has no application to this agreement between them.

12. INDEMNITY
The organiser will indemnify Pinewood against all costs incurred and losses suffered by Pinewood including costs on a solicitor/client basis, resulting from the acts or omissions of the organiser or the guests from the group booked by the organiser.

13. BROCHURE / INTERNET INCLUSION
When Pinewood is included in an Operators Brochure or Internet site, prior to including or publishing of any information, approval should be obtained from Pinewood management. Any Operator displaying unauthorised information on Pinewood will be held liable to Pinewood for all claims or losses suffered by Pinewood as a result of such action.
